is there a legal process involved in order to obtain rights to use an urban legend in a story?
If i were to write a book or make a movie based on an urban legend, would i need to obtain rights to it? If so who do I get this permission from and what are the legal implications?

You need to investigate if the character is copyrighted or not, If it truly legend, fictional, and without a a copyright protection you are good to go.
